| الوصف: | La presente tesis doctoral realiza una propuesta normativa para regular jurídicamente una relación socialmente muy diversa: la que se da entre un hijo o hija y la pareja de uno de sus progenitores o «adulto afín». La propuesta, cuyo alcance es el derecho civil (y, en particular, el derecho de familia) contiene tres instrumentos o mecanismos alternativos. Estos toman como punto de partida ideas como las de parentalidad funcional o socioafectividad, de desagregación parental y de multiparentalidad. De esta manera, el rol del adulto afín se reconocería en base a su ejercicio efectivo de ciertas funciones parentales (si bien, no necesariamente de todas ellas) en posible adición a dos progenitores completamente funcionales. Los instrumentos propuestos se inspiran en parte en otros ya existentes en el derecho comparado y son (1) un estatuto de «cuidador afín», (2) la atribución de responsabilidades parentales y (3) una forma de adopción «aditiva». Además de la aplicación automática del primero de los regímenes tras dos años de convivencia familiar, las familias reconstituidas podrían optar entre los otros dos. De esta manera, se pretende regular la relación afín teniendo en cuenta tanto la protección de los menores como la autocomposición familiar. |
| الوصف (مترجم): | This doctoral thesis puts together a normative proposal to legally regulate the relationship between a child and their stepparent, which is particularly diverse from a social point of view. The proposal is circumscribed to the field of private family law and contains three alternative instruments or mechanisms. These take as their starting points ideas such as functional parenthood, parental disaggregation, and multiparentality. Thus, the stepparent role would be recognized based on their effective exercise of certain parental functions (not necessarily all of them) and possibly in addition to two fully functional parents. The proposed instruments are partly inspired by already existing ones in comparative law and are (1) a “caregiver” status, (2) the attribution of parental responsibilities, and (3) a form of “additive” adoption. The first regime would automatically operate after two years of cohabitation whereas the other two could be voluntarily adopted by the families themselves.
