| الوصف: | This article aims to investigate the relationship between the principle of legality and the regulatory power of art. 84, combined with art. 174, both of the CF/88, to examine the regulatory function of so-called "regulatory agencies". Therefore, we used bibliographic research methodology and deductive method of evaluation. It appears that only regulatory rules that meet the principles of legality and separation of powers, in close relation to the technical limits imposed by the law establishing the regulatory agency can be considered valid. ; O presente artigo objetiva verificar a relação entre o princípio da legalidade e o poder regulamentar do art. 84, combinado com o art. 174, ambos da CF/88, para analisar a função regulamentar das chamadas “agências reguladoras”. Para tanto, foi utilizada metodologia de pesquisa bibliográfica e método dedutivo de avaliação. Verifica-se que somente normas regulamentares que atendam aos princípios da legalidade e da separação dos poderes, em estreita relação com os limites técnicos impostos pela Lei que cria a agência reguladora, podem ser consideradas válidas. |
