The article discusses the proliferation of the expanding class of plaintiffs for the Employee Retirement income Security Act (ERISA). Topics discussed include employees and their dependents as participants protected by ERISA, the increasing concern of legal courts in the commoditization of ERISA claims, and two Supreme Court cases which served as motivations for the emergence of a need breed of ERISA claimants.
