| الوصف: | The object of this paper is to analyze the criteria used to justify the adoption of the principle of insignificance in insignificance in the crimes of smuggling and embezzlement. Understand how these means is used, demonstrating the way that acts the principle of insignificance in the offenses of smuggling and misappropriation. Therefore, it is necessary to draw an evolutionary line of jurisprudence in the Superior Courts regarding the use of the principle in the crimes mentioned, measure the distinction between the principle of insignificance and the principle of criminal irrelevance of the fact and describe the criteria for identifying the agents used in the admission of the application of the principle in the offenses of smuggling and embezzlement. Also, it deals with the discussion of why many consider this institute as a form of impunity, if its use provides conditions to clarify the mind of the opposing current, if possible, in the distinction between what are the objective and subjective criteria used for the application of the principle of insignificance. Therefore, the application of the principle will be admissible when the injury is minimal or irrelevant, considering some criteria of the offending agent. Consist in the rejection of the incidence of the conduct in the criminal type in the crimes of smuggling and embezzlement. ; El objetivo de este trabajo es analizar los criterios utilizados para justificar la adopción del principio de insignificancia en insignificancia en los delitos de contrabando y malversación. Entender cómo estos medios se utiliza, lo que demuestra la forma en que actúa el principio de insignificancia en los delitos de contrabando y malversación.
