The article proposes a standard for evaluating Establishment Clause issues which combines the Lemon v. Kurtzman test and the history and tradition tests to create multifactorial subjective-objective test. Topics include history of the Establishment Clause, reasons for its enactment and its application to moment of silence laws; history and tradition test to Florida's moment of silence statute; and why the subjective-objective test is a preferred method to resolve Establishment Clause issues. |
