مستخلص: The exemptions from the antimonopoly law in Japan can be divided into two kinds, i. e., the definite exemption and regressive exemption, according to the relationship between the anti-monopoly law and exemption. The former aims to protect SME's competitiveness and the certain act in intellectual properties field so as to benefit the maintenance of competitive mechanism. It shall be executed necessarily with the enhanced competition policy. The latter is to be executed under the conditions the market economy has not been developed perfectly yet for the purpose of governmental industrial policy to incubate related industries and develop economies of scale, i. e., it goes against the aim of the antimonopoly law which keeps on the competition. So, the latter will unavoidably be abolished gradually along with the perfected market mechanism and enhanced competitive policy. The Japanese experience and lessons as above are beneficial to China to a certain extent with respect to how to coordinate the mutual relationship between competition policy and industrial policy by way of introducing the exemptions.
