مصطلحات موضوعية: The article deals with the Grand Chamber of the Court of Justice of the European Union (CJEU) ruling in the case Gómez del Moral Guasch c. Bankia SA (C-125/18), concerning the contractual term governing the variable ordinary and remunerative interest rate in a mortgage loan agreement. Firstly, the Court of Justice states that even if the contractual term which provides the interest rate applicable to the loan is based on one of the official reference indices (IRPH - Índice de Referencia de Préstamos Hipotecarios), it falls within the scope of the directive 93/13 since it does not reflect a statutory or regulatory provision that is mandatory or supplementary. Moreover, the decision sets the transparency requirements of that clause and the consequences resulting from the unfairness of the term at issue. Despite the clarifying efforts of the judgment, it does not appear to have definitively solved the problems raised by the use of the IRPH index, and new questions have been referred to the Court of Justice., Settore IUS/01
