مستخلص: This article examines how the Spanish courts have tackled trade mark and copyright disputes involving Internet. As in all other countries, the Internet has had a great impact in Spain. One proof of this is Law 34/2002 of Services of Information Society and E-Commerce. This law imposes an obligation on all so-called providers of services in the information society and contains threat of very important economic sanctions. Without doubt the Internet is a platform for commerce, publicity and knowledge but it can also be a source of abuses, including intellectual property. Within the great number of situations which establish a link between the world of the Internet and intellectual property, sometimes in open collision and other times complementing each other, the conflict between domain names and prior registered trade marks has gradually become relevant in Spain. Due to the lack of legal regulation until very recently, such conflicts have been decided by our courts on the basis of trade mark law.
