| الوصف: | The discussion about the ends of punishment is maybe one of those reaching a higher degree of abstraction in modern criminal law discourse. Therefore, this legal discussion becomes a lively debate but without a practical application. However, if it is true that the theory of punishment is the foundation of the whole penal system, it should be mandatory to link it with the concrete regulation of every criminal phenomenon. In particular, if we draw from a pure consequentialist punishment theory, this assumption must be the benchmark for the criminalization of the conduct and not just the application of punishment. With this perspective, the legal treatment of one of the phenomena currently most stressing criminal law, namely, terrorism, with special attention to the proliferation of precursor crimes in this field, is analysed by reference to the ends of punishment. In this way, the means and ends of criminalisation can be unified and coherent |
