ABSTRACT- This commentary on Warshak's article on the American Law Institute's approximation standard emphasizes that the standard provides parents with a concrete framework for negotiation and is likely to be a valuable resource for courts and policymakers. It also highlights the fact that by focusing on actual parenting conduct, the standard is designed to replicate individual family choices and will necessarily reflect broader changes in the American family, including evolving approaches to fatherhood. Although quantity of caretaking may not be a valid proxy for quality of attachment in all cases, it is preferable in many cases to the indeterminate and subjective best-interests test.
