مستخلص: Feminists and Westerners have conducted a criminalization campaign in order to prohibit female genital mutilation in the West. There have been several landmark cases such as Kasinga in 1995 and the United States and certain European nations have outlawed FGM. During the enactment of this prohibition regime, seeking asylum for the reason that a young woman will be genitally mutilated has become increasingly more common. FGM is now considered an act of violence in Western law. Despite criminalization, the negative reaction in receiving countries towards granting asylum, a human right, has resulted in inconsistent application of asylum law to protect women and girls. For example, there is no consistently applied basis for the legal relief of a refugee parent who fears returning to her home country because of her daughter's likely mutilation. An examination of how the process of criminalization interacts with asylum is important for understanding the degree to which the West is willing to extend relief for potential victims of this prohibition regime.
