New technologies have been benefiting men, but, at the same time, have been generating noxious consequences to their health and the environment (especially to the fauna). The luminous pollution, consistent in the undesirable result of the benefits' fruition of the luminous energy, for being invisible, did not deserve, up to now, the jurists due attention. It is necessary for this improper and excessive use to be acknowledged, as de rigueur, with the status of pollution, bearing the juridical consequences that follow. It is the Public Power's duty, applying the principle of prevention and polluter-payer, to fight this new form of human's health and environment degradation. It hits, fatally, the environmental comfort. Regarding this form of pollution, the difficulty relies on dimensioning the damages caused and not on verifying it. [ABSTRACT FROM AUTHOR] |
| Abstract (Portuguese): |
As novas tecnologias têm trazido benefícios ao homem, mas, ao mesmo tempo, têm gerado consequências nocivas à sua saúde e ao meio ambiente (especialmente à fauna). A poluição luminosa, consistente no resultado indesejável da fruição dos benefícios da energia luminosa, por ser invisível, não mereceu, até o momento, a atenção devida dos juristas. É necessário que esse uso indevido e excessivo seja reconhecido, como é de rigor, com o status de poluição, com as consequências jurídicas que advêm daí, sendo obrigação do Poder Público, aplicando o princípio da prevenção e do poluidor-pagador, combater essa nova forma de degradação do ambiente e da saúde humana. Ela atinge, fatalmente, o conforto ambiental. Em se tratando dessa maneira de poluir, a dificuldade está no dimensionamento do dano causado e não na constatação. [ABSTRACT FROM AUTHOR] |
