The implementation of penal mediation in traffic accident which the victim and suspect have a family relationship by Probolinggo Kota Resort Police is supposed to know the reasons or considerations of implementation in penal mediation and to analyze how the process of penal mediation as the alternative penal settlement. The method used in the research was empirical law research. The results of research are penal mediation was implemented in order to create a sense of fairness and humanity, penal mediation focused on the interest of victim and suspect to achieve win-win solution, and there is an opinion in society that some cases can be solved as efforts to make peace. On the other hand, the implementation of penal mediation, consists of: Reconciling the parties, the parties make a letter of agreement, the investigator receives a letter of revocation cases (police report), and doing a case discussion about it. |
