An essay is presented on Gerber's theory which explains the relationship between a state's personality, in context to the criticism of parlamentarism explained by the German constitutional monarchy. Gerber's theory identifies a link between a state's personality and will in an idealist philosophical tradition. It examines that Gerber's theory is a transition between statutory positivism and historical jurisprudence. |
