| الوصف: | Legislation theory constantly prescribes legislative clarity, since it is understood to facilitate precise and comprehensible law. These prescriptions have also been related to Fuller’s thought, and therefore have taken on a moral hue. Despite this, it is unclear how much one can actually speak of morality in legislative clarity. This study attempts to answer that question on the basis of Fuller’s thought. ; La claridad en las normas es una recomendación constante en el ámbito de la teoría de la legislación, dado que se entiende que aquella hace posible el entendimiento de las normas y la certeza. Esta recomendación también se ha relacionado con el pensamiento de Fuller, y ello supone dotar a aquella de un carácter moral. Sin embargo, no está claro en qué medida puede hablarse de moralidad en la claridad de las normas. Este estudio trata de responder a esta cuestión, partiendo del pensamiento de Fuller. |
