الوصف: The subject matter of this dissertation is the study of non-discrimination and, more specifically, the examination of its relation to the principle of equality. Oriented towards the protection of specific population groups, which are constructed on the basis of a common characteristic, non-discrimination is often thought to be identical to or to derive from the principle of equality and has penetrated, mainly through European Union law, the Greek legal order, where it co-exists with the principle of equality. The working hypothesis of this study is that non-discrimination is not synonymous with the principle of equality, but that, on the contrary, it is a substantive manifestation of the latter, the product of its interaction with the principle of human dignity. The defense of the above working hypothesis begins with the examination of the principle of equality, as a fundamental principle of the Greek legal order and, in particular, with the systematic presentation of the various manifestations of equality (numerical and proportional, before and under the law, equality of opportunity and equality of outcome) and the formulation of the judicial review as a two-stage procedure, the second stage involving the control of possible deviations from the principle of equality for reasons of public interest. Subsequently, the focus of the study shifts to the systematic examination of non-discrimination law that has emerged historically since the beginning of the 20th century as the product of complex social processes, mostly of the anti-discrimination movements: firstly, the ever-evolving types of discrimination (direct and indirect discrimination, intersectional discrimination, harassment, profiling) and then the various procedural rules incorporated in non-discrimination legislation are presented (different levels of scrutiny, reversal of the burden of proof, hypothetical comparator, indirect evidence).
